1 DEFINITIONS In these terms and conditions of business the following definitions apply:-
1.1 “CLIENT” Means any person,company,organisation,firm or any cooperate body and any subsidiary or associated company that places adverts and purchases services from Midlands Careers.
1.2 “THE BUSINESS PROVIDER” Means Midlands Careers Limited (5974917) trading as Midlands Careers Limited.
1.3 "CANDIDATE" Means a person who uses the services provided by Midlands Careers for their own purpose of searching for employment, training or further education. 1.4 "APPLICANT" Means a candidate who applies for a vacancy, which has been placed on the site.
1.5 "SITE" Means www.midlandscareers.co.uk and all associated pages, information and external advertising to support Clients and Candidates in their employment, career and training requirements.
1.6 "CONTRACT" Means the supply of any services by Midlands Careers to the Client using these Terms and Conditions of Business.
1.7 "ADVERT" Means a position or many positions that are placed on the site for recruiting potential Candidates for employment, Training or Further education courses.
2 ADVERTISING 2.1 The Client is responsible for ensuring all Adverts conform to Legal requirements as governed by The Employers Act 2006.Employment Agencies and Employment Businesses have an obligation to adhere to standards by the Employers Agencies Act 1973, Regulations Act 2004 and 2006.
2.2 Adverts that appear to discriminate on grounds of sex, disability or race are illegal, will be removed without prior notice, and may result in proceedings. For avoidance of doubt please refer to the employers act and the Clients own Governing bodies.
2.3 The Client will conduct themselves with professionalism and will deal with all Applicants equally and fairly when responding to Adverts.
2.4 The Client will indemnify the Business Provider from any claim made from an Individual by breaching the obligation in 2.3.
2.5 The Client will monitor its own add response and will manage all vacancies and Adverts placed on the Site. Any Candidates will be the Clients responsibility for ensuring their suitability for Employment, Training and Further education.
2.6 The Client will ensure the suitability of the candidates and will conform to its own recruitment and legal requirements for processing of all applicants.
2.7 Placing an advert on the Site/The Careers and Business Mail and/or informing the Business Provider of what Option Package will confirm acceptance of these terms and conditions of business.
3 PAYMENT TERMS
3.1 The fees and charges are detailed in these terms as stated in Payment Terms clause 3.1, 3.2, 3.3, 3.4 and 3.5
3.2 Once an Advert has been placed, the contract has been agreed and will remain in force until the agreed end date has been completed.
3.3 The Business Provider has the right to decline, suspend, or cancel an advert without giving written notice if payment terms are not honoured, the Business Provider reserves the right to charge any overdue Payment Terms at the rate of 4% per annum above the base rate from time to time of Barclays Bank from the due date until payment.
3.4 Payment terms are Standard 30 days after date of placing first Advert. For the avoidance of doubt, the Client is not using an Agreed Option package and accepts these as standard Payment Terms. All prices include VAT.
4 THE CONTRACT
4.1 These terms govern the right to use the service of the Business Provider by the client and are deemed to be accepted by the client by virtue of it's request to place Adverts on the Site.
4.2 No variation or alteration to these terms and conditions of business will be valid or approved unless the business provider agrees them in writing.
4.3 These Terms and Conditions prevail over any terms or purchasing terms that the client provides for its own recruiting sources.
5 LIABILITY AND INDEMNITY
5.1 Midlands Careers accepts no liability for any loss of business, damage or negligence meaning direct or indirect by the client who uses this site. For the avoidance of doubt, the Business Provider does not exclude liability or personnel injury arising from its own negligence. The Business Provider accepts no liability and will be indemnified by the client for any description, including misuse of the Site and the services provided by the Business Provider. This also includes any loss or damage to computer equipment caused by viruses, cookies, and acts of negligence by the client, applicants or alternative sources. which includes but is non exhaustive to third party use, computer programs attachments etc. Any mistakes placed in the adverts by the Client be it direct or indirect and which results in any of the aforementioned liabilities and loss of business, the Business Provider will be indemnified. Any loss of client details including data and any mistakes in publication of the Adverts on the Site the Business provider will not be liable. The Business provider is indemnified from any claim from the client under any position including but not exhaustive to copyright of Clients advertising campaigns, business plans, future recruitment requirements and any claims of misconduct from a discriminative act including but not exhaustive to religious believes, sexual or racial discrimination disability etc.
6 APPLICANT
6.1 Applicants Midlands Careers use of CVs and Resumes and other personal information supplied by users of this site is governed by our privacy policy. Midlands Careers will provide additional help and support for applicants as requested by each applicant
Use of the site
The information and services available on the site are provided for the sole purpose of individuals looking for employment opportunities and career information and for employers seeking to recruit staff. You may use, print and download information from the site for these purposes only and for no other personal or commercial purpose. You may not otherwise copy, display, transmit or distribute any material from the site.
Copyright
All copyright, database rights and other intellectual property rights in the site and the material available on the site belongs to Midlands Careers Limited. By using this site and Midlands Careers Limited will not give you any proprietary rights for such materials. We accept no responsibility for the consequences of interruptions or delays, however caused. We may periodically and in addition amend the design and specification of the website at any time.
CVs and job advertisements contained on the site are provided by candidates and by prospective employers and their agents and are not reviewed by us. We accept no responsibility or liability for the contents of CVs or advertisements and expect candidates and prospective employers to carry out such verification procedures as are customary and prudent in the circumstances.
Midlands Careers Services and information provided on the site by us and our third party suppliers are intended to assist in the job seeking or recruitment process. Neither we nor our third party suppliers can guarantee their suitability or prospects of success in any particular case. You should obtain independent verification before relying on information provided on the site in circumstances which may result in loss or damage.
On going Support and Services
We endeavour to provide continuous availability of the Website and provide all the products available and associated with Midlands Careers Limited. Midlands Careers use of CVs and Resumes and other personal information supplied by users of this site is governed by our privacy policy a copy of our privacy policy available through the contact page on the website.
These terms and conditions are interpreted and governed by the law of England and Wales and exclusitivity to the jurisdiction in the legal courts of law in England and Wales.
CVs and job advertisements contained on the site are provided by candidates and by prospective employers and their agents and by Midlands Careers are not solely reviewed by us. We accept no responsibility or liability for the contents of CVs or advertisements and expect candidates and prospective employers to carry out such verification procedures as are customary and prudent in the circumstances.
All CV Applications for jobs will be sent through Midlands Careers when applying to jobs and sent on to the Client.
CVs are uploaded by the applicant and Midlands Careers are not liable for any loss or damage in this process.
Please refer to the privacy policy for further information on data that is collected. All documents that are uploaded and sent directly to Midlands Careers may be searched and viewed by prospective employers, Midlands Careers and Third Parties who may be involved with recruitment process or from a technical role in support of maintenance to the website or the Midlands Careers database. Midlands Careers will retain records of all CVs that are uploaded onto www.midlandscareers.co.uk And this will be in line with our Privacy Policy.
